Assumption of Risks, Waiver of Liability, and Indemnity Agreement

Assumption of Risks:

Physical activity, by its very nature, carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. Ayn Devera DBA Inner Soulstice Wellness has facilities for and provides activities such as weight training, yoga, and Pilates. Additional services include bodywork, skincare, and nutrition counseling.

I hereby assert that my participation is voluntary and that I knowingly assume all risks. I further warrant and represent that I am in good physical and mental health and not suffering from any condition, disease or disablement which would or could potentially affect participation in activities and services at Ayn Devera DBA Inner Soulstice Wellness.

Waiver:

In consideration of permission to use (today and on all future dates) the property, facilities, equipment, activities, and services (collectively, the “Facilities and Services”) of Ayn Devera DBA Inner Soulstice Wellness, I, individually, as well as my heirs, personal representatives hold harmless Ayn Devera DBA Inner Soulstice Wellness, as well as its respective current and former employees, officers, directors, shareholders, agents, successors and assigns (collectively, “Ayn Devera, DBA Inner Soulstice Wellness,”) from all liabilities, claims, demands, or causes of action (past, present or future) that I have or may hereafter have as a result of my participation at Ayn Devera DBA Inner Soulstice Wellness.

General Release and Indemnification:

I on behalf of myself, heirs, successors, creditors and assigns, unconditionally, irrevocably and absolutely indemnify, release and discharge Ayn Devera DBA Inner Soulstice Wellness Studio from and against including without limitation all liabilities, claims, demands, causes of action and damages, including attorneys’ fees, resulting from any accident, incident, occurrence, damages or death, and arising out of, incidental to or in any way resulting from, my participation in facilities and services at Ayn Devera DBA Inner Soulstice Wellness.

Severability and Venue:

I agree that the foregoing waiver and assumption of risks agreement is intended to be a “general” release and waiver, and is to be interpreted as broadly and inclusively as is permitted by the law of California, and that if any portion thereof is held invalid, it is agreed that the remaining portions shall continue in legal effect. I agree that any legal action must be brought solely in Ventura County, California.

Acknowledgment of Understanding:

I have read and understand the above and wish to participate in the facilities and services offered by Ayn Devera DBA Inner Soulstice Wellness. This waiver shall remain in effect until revoked in writing by me, the client, and acknowledged in writing by an authorized representative of Ayn Devera DBA Inner Soulstice Wellness.

By booking a session or class at Ayn Devera DBA Inner Soulstice Wellness, you acknowledge that you have been advised of the studio’s policies and liability terms expressed here and agree.
